A family-based visa is a type of immigrant visa that allows a relative of a U.S. citizen or legal permanent resident (Green Card holder) to come to the United States.
The kinship process also takes visa availability into account. In some instances, the foreign relative may need to wait until an immigrant visa becomes available during the fiscal year. Visa availability depends on the nature of the kinship relationship and the applicant's nationality. Accordingly, the following categories are recognized:
1. Family preference: for specific, more distant family relationships with a U.S. citizen and some specific relationships with a Lawful Permanent Resident (LPR). The number of immigrants in these categories is limited each fiscal year.
2. Immediate Relative: based on a close family relationship with a U.S. citizen, such as a spouse, child, or parent. The number of immigrants in these categories is not limited each fiscal year.
The resident or citizen must be responsible for applying for the Green Card and it is mandatory to prove certain financial conditions and the family relationship using documents requested by the USCIS. Here are options for petitioning for family members and spouses.
