The EB-1 visa, also known as the “Extraordinary Ability Visa”, is designed for professionals recognized as leaders in their field. With a waiting period between 2 to 12 months, this visa caters to individuals with exceptional achievements in athletics, education, business, arts, or sciences.

Who is Eligible for the EB-1 Visa?

EB-1A: Extraordinary Ability (No Job Offer Required)

This category is open to professionals who can demonstrate extraordinary abilities, often through national or international recognition. While it is true that some recipients include winners of prestigious awards like the Oscar, Pulitzer, Nobel Prize, or Olympic medals, you don’t need to have such accolades to qualify.

U.S. immigration law provides a list of 10 criteria, and you only need to meet 3 out of the 10 to be eligible:


  1. National or International Awards: Proven receipt of recognized awards in your field.
  2. Membership in Prestigious Associations: Membership in organizations requiring outstanding achievements.
  3. Major Media Coverage: Articles or features about you in high-profile media outlets.
  4. Professional Contributions: Evidence of significant academic, artistic, or    business contributions.
  5. Published Work: Authoring scientific articles or publications in reputable journals.
  6. Artistic Exhibitions: Participation in public exhibitions or shows.
  7. Leadership Roles: Serving in a leading capacity in organizations with excellent reputations.
  8. High Salary: Earning significantly more than others in your field.
  9. Judging or Evaluating Work: Participation as a judge in professional events or competitions.
  10. Commercial Success: Achievements in the performing arts, such as record sales or box office hits.


Key Requirement: Applicants must show intent to continue their professional activity in the U.S. Evidence such as letters from collaborators, contracts, or professional partnerships will strengthen your application.

EB-1B: Professors and Researchers

This category is for internationally recognized professors and researchers with:


  • At least 3 years of experience in teaching or research.
  • A job offer from a U.S. institution or employer.


Applicants must demonstrate significant contributions to their academic or research field.

EB-1C: Managers and Executives

The EB-1C is tailored for managers or executives of multinational companies who:


  • Have worked for the international branch of a U.S.-based company for at least 1 year in the past 3 years.
  • Are transferring to the U.S. branch to continue their managerial role.


In this category, the employer submits the application on behalf of the employee.
